Contesting the Validity of Severance Agreements

A situation in which an employer threatens to dismiss an employee for cause if the employee does not sign a severance agreement may constitute unlawful coercion and provide grounds for challenging the agreement in court. This is not, however, the case if an employer has good reason to consider dismissal for cause on the basis of the concrete circumstances. The employer is then also under no obligation to prove that the allegations are accurate.
