In its decision dated December 9, 2024, the Cologne District Court clarified that in restructuring proceedings under the StaRUG, the joint representative of all bondholders (gV) alone is entitled and obliged to assert the rights of the bondholders. The gV can therefore approve measures in the StaRUG proceedings, even if it is not expressly granted this right outside the restructuring proceedings.
