GÖRG successfully advised and represented Charité – Universitätsmedizin Berlin in summary proceedings before the Berlin Labour Court regarding the staffing of emergency services during announced strike days, in accordance with employment law. The Berlin Labour Court fully upheld the emergency staffing arrangements sought by Charité. This establishes a binding framework for staff deployment during the forthcoming strike days, ensuring that the necessary medical care is provided.
The urgent proceedings were prompted by a disagreement between Charité and the trade union ver.di regarding the organisation of the emergency service. The main focus was on how the medical urgency of individual treatments should be assessed.
Emergency service regulations specify how many staff must be deployed to maintain urgent medical, nursing and hygiene services, as well as other essential public services.
The Labour Court’s decision provides a binding clarification of the framework conditions for staffing the emergency services. It takes into account both the necessary medical care for patients and the employees’ right to strike.
These confirmed emergency service regulations will also apply in the event of further strikes or an extension to existing strike.
