The forfeiture of the employee's right of action to assert the transfer of his employment relationship to the acquirer of the business pursuant to section 613a (1) BGB (only available in German language)

This article examines the prerequisites for the forfeiture of the right to sue and develops cross-case principles. The results found can also be applied to cases of the reorganisation-related transfer of individual functions or assets to another legal entity outside of insolvency.
