GÖRG advises Munich Airport on the strategic procurement of green electricity via an offshore PPA

GÖRG advised Munich Airport on all legal aspects of the preparation and implementation of a Europe-wide tender process for the procurement of green electricity via a Power Purchase Agreement (PPA).

The objective of the tender was the long-term supply of around 40 GWh of electricity per year from newly constructed offshore wind farms. Through the PPA, Munich Airport ensures that the green electricity required for its infrastructure, such as buildings and aprons, is sourced directly from a wind farm. With the successful conclusion of the PPAs, Munich Airport is consistently pursuing its Net Zero 2035 sustainability strategy. The supply of green electricity makes a significant contribution to Munich Airport’s own energy supply and, with savings of approximately 13,000 tonnes of carbon dioxide per year, plays a key role in achieving its climate targets. The supply is provided without any subsidies under the Renewable Energy Sources Act (EEG) and includes the provision and transfer of guarantees of origin.

Following the completion of the tender process, an intensive round of negotiations was conducted with a shortlisted group of bidders, focusing on the commercial, technical and legal terms of the PPA. RWE Supply & Trading GmbH emerged as the most economically advantageous bidder, with whom a contract for the long-term supply of green electricity has now been concluded.

An interdisciplinary team from GÖRG, led by Frankfurt-based partner Dr Heiko Hofmann and Berlin-based partner Dr Liane Thau, supported Munich Airport with the structural and legal design of the procurement process and the contractual implementation of the PPA, drawing on their expertise in energy law, public procurement law and contract law. Following the support provided to the Frankfurt airport operator FRAPORT, this project represents a further successful tendering process for the procurement of a PPA for an infrastructure operator with GÖRG’s involvement (cf.
