GÖRG’s healthcare practitioners advise and represent pharmaceutical companies, including contract manufacturers, as well as research and development institutions on all questions involved in the distribution and sale of pharmaceutical products.

This practice group provides guidance in connection with manufacturing and import permits, approval of pharmaceutical products, strict liability and questions concerning voluntary recalls of pharmaceutical products or recalls initiated by governmental authorities. These activities also include communication and dealings with federal agencies such as the Federal Institute for Drugs and Medical Devices (Bundesinstitut für Arzneimittel und Medizinprodukte – BfArM) and the Paul Ehrlich Institute as well as the relevant regulatory authorities. Clients also rely on our Healthcare Practice Group to draft contracts such as agreements intended to define and limit responsibility for pharmaceutical products, and GÖRG’s specialists are exceptionally well versed in the intricacies of the law governing pharmacies, pharmaceutical wholesalers and medical products. In this area, we regularly advise clients on issues in connection with pharmaceutical imports and the legal aspects involved in advertising such products as well as IP protection for brands and designs. GÖRG clients also benefit from our extensive experience in M&A transactions in the healthcare area.

In addition, GÖRG advises operators of healthcare facilities (in particular hospitals) in crisis situations. Advice in this area covers the design and implementation of non-judicial financial restructuring plans as well as the development of insolvency plans. Finally, we advise executives on measures that can be taken to avoid liability and assume responsibility for managerial functions in crisis situations, in particular in the case of debtor-in-possession scenarios.
