GÖRG provided legal advice to the administrative district of Marburg-Biedenkopf on the acquisition of the DRK Hospital in Biedenkopf. The district took over the hospital on January 1, 2026, and continues to operate it under the name Hinterland-Klinik.
On September 26, 2025, the district council of Marburg-Biedenkopf unanimously approved the takeover of the DRK hospital in Biedenkopf. The district had already assumed responsibility for hospital care deficits from the hospital's operations after insolvency proceedings were opened against the assets of the original hospital operator (Deutsches Rotes Kreuz Kreisverband Biedenkopf e. V.) at the end of 2023.
As part of the project, the legal structure was developed for the transfer of hospital operations to a non-profit operating company (gGmbH) and the hospital real estate to a separate operating company, both under the auspices of the district of Marburg-Biedenkopf. The contracts were closely coordinated with the public authorities, local political decision-makers and key stakeholders in the healthcare and hospital sector. In addition, negotiations with the insolvency administrator were closely monitored.
The acquisition secures the long-term continuation of the Biedenkopf hospital site and ensures the provision of needs-based local medical care for approximately 66,000 people. It also preserves around 200 jobs in the region and maintains the hospital's role as a training and teaching hospital as well as a significant regional economic factor.
An interdisciplinary GÖRG team led by Frankfurt partners Dr Heiko Hofmann and Dr Matthias Menke advised the district Marburg-Biedenkopf on the structural and legal design of the hospital takeover and in the implementation of the transaction with expertise in public procurement law, corporate law, hospital law, labour and employment law, municipal law, real estate law, EU state aid law, tax law, and contract law.
